The case against Trump in Florida has been dismissed. Seems it has to so with the irregular appointment of Jack Smith. More info to come as this story is minutes old.

It’s a nonsensical decision without firm legal grounding, contrary to much established case law. This lets Smith appeal the dismissal to the 11th circuit, which has not been kind to Judge Cannon on prior appeals. That should see the case recommenced under a different judge who isn’t so transparently playing games. DOJ may take the opportunity to refine the scope of its indictment to account for the SCOTUS immunity ruling.

Alternatively, Smith could re-file the indictment in DC on a narrower selection of charges. Either way this matter is decidedly not dead.
 
Anyway, the appeal courts will figure it out, that is their job.
If it's appealed. The circuit might be sympathetic to the SC, but the USSC might not. The prosecutors might end up rolling the dice on an answer the people who favour SCs (as currently constituted) don't want to hear from the USSC. Smarter to just re-file what they can in DC.

Yep, for sure. Except I can't reliably comment on the decision being without firm legal grounding, I'll leave that to others.
 
Not really. This has been low-key, but it has been out there for a while. The theory of the objection is straightforward. It also isn't something that was just engineered to extricate Trump - it drew the support of people who have wanted to end special counsel appointments unless and until Congress passes legislation granting authority to make them.

All the more reason to put the issue in front of the wise learned objective Democrat-appointed justices at the USSC so they can talk sense into the other Trump-appointed sycophants and definitively enshrine the AG's power to appoint SCs.

The candidates for Trump's nominations were not screened with a view to particular landmark cases, but rather with a view to specific ideas about constitutional separation of powers. Any issue presented before the court which offers an opportunity to re-evaluate encroachment of one branch on another, and particularly to reign in executive branch overreach, risks a result contrary to what supporters of a more powerful executive branch would like.]
