Full judgment (25 pg.) attached..... The Attorney General of Canada seeks an order staying a “Public Interest Hearing” to be held by the Military Police Complaints Commission until the final determination of two applications for judicial review brought by the Attorney General. The hearing is to examine complaints received by the Commission with respect to the transfer of detainees held by Canadian Forces’ personnel in Afghanistan to the custody of Afghan authorities. The Attorney General’s applications for judicial review challenge the jurisdiction of the Commission to investigate the subject matter of the complaints. For the reasons that follow, I find that the Attorney General of Canada has not demonstrated with clear and convincing evidence that irreparable harm will result if the stay is not granted. As a consequence, the motion will be dismissed ....
