Just received notice about the settlement of this class action, hearing scheduled 10 a.m. EST on December 18, 2023.

This is regarding Miscalculation of Disability Pensions.

This appears appears to be different than the one that was recently settled Logan v. Her Majesty the Queen.

The class of this one includes anyone who received one of the following between 2003 and 2023;
  • Pension Act: pension for disability; pension for death; attendance allowance; allowance for wear and tear of clothing or for specially made apparel; and exceptional incapacity allowance;
  • Veterans Well-being Act: disability award; and clothing allowance;
  • Veterans Well-being Regulations: remuneration of an escort;
  • Veterans Health Care Regulations: remuneration of an escort; and treatment allowance;
  • Veterans Review and Appeal Board Act: compassionate award;
  • Civilian War-related Benefits Act: war pensions and allowances for salt water fishers, overseas headquarters staff, and air raid precautions workers; and injury for remedial treatment of various persons and voluntary aid detachment (World War II);
  • Children of Deceased Veterans Education Assistance Act: monthly allowance for education; and
  • Flying Accidents Compensation Regulations: flying accidents compensation.

 
Good, but I don’t see what they settled for? Am I not seeing something?

Technically nothing is settled yet, that is suppose to happen in December.

But from what I can tell, is if anyone had any sort of financial claim through vac during the last 21 years, you were short changed in some way.

Even after this they will find someway to screw people over.

There is the understatement of the century.😆
 
From what I understand this lawsuit is mostly to do with interest and punitive damages as VAC has paid most of the class back already. For most these are very small amounts.
 
Read a little about this, they say the average amount will be $2000-$3000, but since that's the average, obviously some will be higher.

It's mostly related to not paying interest on backpay owed, I think the main thing that kicked it off was that top up we got back in 2018 for those of us who recieved it (mostly the ppl who get the lump sum after they phased out the PFL back in 2007). I remember thinking it was off at the time because they only indexed it the correction to inflation every year but didn't add any interest on it. As I'm at 100%, my top up was $40,000, and since I was injured in 2007 it was about 11 years too late. Even if we assumed 2% interest rate, that should be about $9000. That said, I don't know how they're going to calculate it and I'm sure it will be with the least generous assumptions.
 
So, obviously this will apply to us guys who had several Lump Sum amounts from Favourable conditions as well? All mine were from 2017 to present.

I mean, 330,000 vets has to be pretty close to all of them, if you've gotten any sort of award I'm sure you qualify for something.

Is that 2000-3000$ average per person or per claim you think?
 
Everything was settled yesterday. Everything is published on the csat veterans site.

Kmlaw.ca and look at news or documents. Explains why disability awards are not part of the settlement.
